Discussion Question:
Please respond to ONE of the following prompts.

Debate why nurse should and should not donate their services.

OR

What advice should be given to nurses seeking employment as occupational health nurses or school nurses about their potential legal liability?Legal and Ethical Issues in Nursing Sample Paper

From a legal perspective, nurses can rightfully donate their services based on their scope of training and practice to improve a patient's health. Service donation is even encouraged when the services provided serve the patient's best interest. A perfect example of such a case is during an emergency. The Good Samaritan Act protects nurses from potential errors that may occur in such situations and grants them permission to donate essential services (Guido, 2014).

However, the services donated should strictly be within a nurse's job description, scope of training, professional code of ethics and practice. In instances where nurses' act contrary to what is ethically and professionally expected, they are likely to afterwards face legal action that may result to licensure withdrawal or other disciplinary actions. This means that, although nurses should donate their services, they should only practice what is outlined in their professional code of practice (Guido, 2014).
The fact that the Good Samaritan Act offers nurses protection for any errors made when donating services should inspire them to donate their services when deemed necessary. It should be ensured that decisions made are for the patients benefit, morally acceptable and for the patient's best interest (Guido, 2014). However, in the likelihood of trial following a lawsuit; nurses should decline/refuse to donate their services.Legal and Ethical Issues in Nursing Sample Paper
It should be noted that when a nurse gets to an emergency scene and does not provide the necessary assistance, he/she can be sued for negligence especially when a patient's health status deteriorates or he/she succumbs to death (Guido, 2014). This explains why it is essential for nurses to make ethical decisions when helping patients who need medical attention since each decision made has its own consequences depending on the outcomes.
